Industrial Computer Systems 5 Year Limited Warranty
enacted September 1, 2004: Covers Systems and Hardware Components

  1. Lifetime Software Limited Warranty:  The standard warranty on software developed by Industrial Computer Systems covers the function of the system for the life of the project, without any special terms or conditions, except as follows.  a) Source Code, Know How and binary executables shall remain the property of ICS at all times.  b) In the event hardware is mutually determined to require upgrade, replacement, amendment or modification, a suitable Statement of Work will be defined that identifies a billable "product enhancement or redevelopment agreement', which shall govern the price and services provided in connection thereto.  Modifying said Warranty: the warranty provided BY the original manufacture of any software product purchased by us from any third party for use within said projects, shall govern the service and warranty terms and conditions of said derivative works.
     

  2. Five (5) Year Parts Replacement / Repair  and Labor Coverage:  The standard Industrial Computer Systems 5 Year Limited Warranty covers parts and labor repair or replacement (at the sole discretion of our Company) on a return to factory basis.  It covers the Casings, Housings, Passive or Active Industrial Computer Systems Backplane, the Single Board Computer assembly (SBC) [but not the CPU or MEMORY Panels, see below] and any Adapters or Mezzanine Boards we supply, along with products marked with the distinctive "5 Year Limited Warranty" Label as part of their Serial Number Tag.  The limited warranty does not include the LCD Panel, CPU, Hard Drive or other storage peripherals, the Keyboard,  Touch screen or Mouse / Mouse pad each of which each have their own limited warranty described in the documents shipped with your system.  Software is not covered under this warranty.  It is covered elsewhere in your system contract.
     

  3. Other parts not covered above have their own limited warrantees. For example:

    a.  Intel Retail Boxed CPUs are warranted for 3 Years from date of shipment by Intel

    b.  Most DDR Memory Dimms supplied by us have a Lifetime Warranty

    c.  Hard Disk Drives bear the Manufacturer's Warranty supplied by the original equipment manufacturer, for example: most Seagate Hard Drives have a 3 Year from date of manufacturing Limited Warranty

    d.  Consumable parts such as LCD Screens, KVMs, Touchscreens, Keyboards, Mice and Mousepads, etc. are covered by the Limited Warranty shipped in writing with your system, or for 1 year if otherwise not described.
     

  4. Power Supplies have a limited warranty of one (1) year unless otherwise specified in your invoice or in documents shipped with your systems.  Batteries have a 60 day replacement only warranty from date of shipment.  Replacements may be purchased out of warranty if they are available.
     

  5. We reserve the right to repair or replace the components defined in section 1 above, for a period not to exceed 5 years from the ship date of the system to our customer.
     

  6. At no time do we guarantee that the exact same identical parts will be available to upgrade or repair any system, unless otherwise contracted for by the customer, for a period greater than 36 months after the day we first offer said product.  Furthermore, in the case of INTEL CPUs and Third Party Disk Drives and other parts, those parts' availability are controlled by the firms who manufactured them and such their availability is entirely outside of our control.  We will make a best effort to replace damaged parts with equal OR BETTER like parts.  In the event of discontinuation of parts by suppliers we are not responsible for their replacement, however, will at our sole discretion offer the customer an upgrade in replacement of the necessary component "set", less the cost of the failed components it would have been our responsibility to replace under the terms of this warranty.  If a CPU type is no longer available from Intel, the customer may have to purchase a matching replacement SBC and RAM, for example, from us, and obtain the CPU from Intel it chooses to replace the malfunctioning CPU with. 
     

  7. We do not warranty in any manner, third party parts customers purchase for use in our systems.
     

  8. In the event of excess wear and tear, we will repair the damaged unit or replace it at the cost of parts that failed plus labor at the then prevailing hourly rate.  The term "excess wear and tear" refers to use of the system in a manner that would otherwise damage it, cause it to fail in an unexpected manner, or which is not expressly approved by us.  That includes use in poor quality power grids, in hazardous areas without appropriate protective coverings we supply and warranty, open, in contact with fluids or gasses, when dropped, when used onboard transportation systems and not adequately reinforced or suspended in accordance with our design and implementation advice and rules, and other cases of accidental, catastrophic, acts of war or God, natural disaster or otherwise customer misuse of the product.  When you return goods to us, they must be packed in their original packing materials, or suitable replacements purchased from us, and shipped by an authorized shipping company in an appropriate manner.  They must be returned covered by shipping damage insurance sufficient to repair or replace the RMA shipment.  Cost of shipment to us for repair and return to the customer upon repair is the responsibility of the customer, the sole exception being the case of merchandise damaged intransit by the shipper, being the shipper's insurer's responsibility, and/or when a unit is received DOA and can not be repaired without it's return.  In the latter case, return shipping is our responsibility inside Continental USA (CONUS).  All shipping, handling and insurance charges on original shipment are the responsibility of the customer.  All shipping, handling and insurance charges on original shipment or RMA shipment to or from our repair depot for customers outside of continental USA are the sole responsibility of the customer.
     

  9. To insure continuity, the Customer must obtain a "Return to Manufacturing Authorization Number" (RMA Number) from our RMA Depot by phone or email prior to shipping a unit back to us for repair.  Any parts not supplied by us, should be removed from the system prior to shipment, unless otherwise arranged for.
     

  10. This Limited Warranty shall not be construed to imply any provision of services on the customer's premises, nor shall extend beyond the given time limits for any reason.  THIS LIMITED WARRANTY DOES NOT EXPRESSLY PROVIDE NOR BY IMPLICATION PROVIDE ANY GUARANTY OF MERCHANTABILITY NOR FITNESS OF THE PRODUCT, WHICH IS SOLD ON AN AS IS BASIS.  CUSTOMER USAGE INCLUDING BUT NOT LIMITED TO INSERTION OF PARTS NOT SUPPLIED BY US INTO THE SYSTEMS, DISASSEMBLY BY ANYONE OTHER THAN OUR AUTHORIZED SERVICE TECHNICIANS, OR INAPPROPRIATE OR IMPROPER USAGE OF THE SYSTEMS, OR FAILURE TO CONSULT WITH US REGARDING THE USAGE OF THE SYSTEMS, OR THE COMPONENTS THEREOF, INCLUDING BUT NOT LIMITED TO USE WITH POOR POWER SUPPLIES, POOR SIGNAL LEVELS, OR INADEQUATE PROTECTION IN THE USAGE ENVIRONMENT COULD VOID THE ABOVE WARRANTY AT OUR SOLE DISCRETION.  Notwithstanding the foregoing terms, we shall endeavor to accommodate any reasonable situation the customer faces in use of these systems and shall attempt in all situations to apply the 5 Year Limited Warranty to each incident as arises.  In all applicable cases of law, the herein 5 Year Limited Warranty, and all sales, equipment, services and software supplied by us shall be governed under the general business law of the State of New Jersey in all jurisdictional and judicial matters.
